Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Aquarium Companion website and aquarium planning tools (the "Service") operated by Aquarium Companion ("we," "us," or "our"). By using the Service, you agree to these Terms.

You must be able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Aquarium Companion helps users plan aquarium setups, compare products, and review compatibility guidance. Product information, pricing, availability, and recommendations may change without notice and may be provided by third parties. We do not guarantee that any build, alert, or suggestion is complete, accurate, or suitable for your specific situation.

Some features may require an account or allow you to save and share builds. You are responsible for maintaining the confidentiality of your credentials and for activity under your account. Shared links may be accessible to anyone who has the URL.

You agree not to:

  • Use the Service for unlawful, harmful, or fraudulent purposes;
  • Interfere with or disrupt the Service or related systems;
  • Attempt unauthorized access to accounts, data, or networks;
  • Scrape, copy, or resell the Service or its content except as permitted by law;
  • Misrepresent your identity or affiliation.

The Service, including its design, text, graphics, logos, and software, is owned by Aquarium Companion or its licensors and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes unless we agree otherwise in writing.

Your content

You retain ownership of content you submit, such as build configurations. By submitting content, you grant us a worldwide, royalty-free license to host, store, display, and process that content solely to operate and improve the Service.

The Service may reference third-party retailers, suppliers, or websites. We do not control and are not responsible for third-party products, services, policies, or transactions. Your dealings with third parties are solely between you and them.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AQUARIUM KEEPING INVOLVES RISK TO LIVING ANIMALS; YOU ARE SOLELY RESPONSIBLE FOR CARE DECISIONS AND OUTCOMES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AQUARIUM COMPANION AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US $100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.

You agree to indemnify and hold harmless Aquarium Companion and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

We may suspend or terminate access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or harms the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive.

We may modify these Terms from time to time. The "Last updated" date reflects the latest revision. Continued use after changes become effective constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where mandatory local law applies.
